Mi Smile Family Dental is committed to protecting your privacy. As a dental healthcare provider, we are subject to HIPAA and to both Texas and California state privacy laws. This page summarizes your specific rights under each law and explains exactly how to exercise them.

HIPAA — Your Health Information Rights

Applies to: All patients of Mi Smile Family Dental | Federal law | Enforced by: HHS Office for Civil Rights

  • Right to Access Your Records

    Request a copy of your dental records, X-rays, treatment notes, and billing records. We will provide access within 30 days of your request.

  • Right to Amend Your Records

    Request corrections to inaccurate or incomplete health information in your records. We may deny the request if we did not create the information or if we disagree it is inaccurate.

  • Right to an Accounting of Disclosures

    Request a list of instances where we have shared your health information outside of treatment, payment, and operations during the previous 6 years.

  • Right to Request Restrictions

    Ask us to limit how we use or disclose your health information. We are not required to agree to all restrictions, but we must comply if you request we not share information with your health plan for care you paid for out-of-pocket.

  • Right to Confidential Communications

    Request we contact you only at a specific phone number or address (e.g., not your home address). We will accommodate reasonable requests.

  • Right to a Paper Copy of This Notice

    Receive a printed copy of our Notice of Privacy Practices at any time, even if you initially received it electronically.

Texas Resident Rights — TDPSA

Applies to: Texas residents | Effective July 1, 2024 (Texas Business & Commerce Code, Ch. 541) | Enforced by: Texas Attorney General | Response deadline: 45 days 45 days

  • Right to Access & Confirm

    Confirm whether we process your personal data and request a copy of the specific personal data we have collected about you.

  • Right to Correct

    Request that we correct inaccurate personal data we hold about you, taking into account the nature of the data and our purposes for processing it.

  • Right to Delete

    Request deletion of personal data you have provided or that we have collected about you. Certain legal exceptions apply (e.g., data required for legal compliance).

  • Right to Data Portability

    Receive a copy of your personal data in a portable, machine-readable format that allows you to transmit it to another controller.

  • Right to Opt Out of Targeted Advertising & Profiling

    Opt out of processing your personal data for targeted advertising, sale, or profiling that produces legal or significant effects. We do not engage in these activities, but your opt-out request is always honored.

  • Right Regarding Sensitive Data (Geolocation)

    Precise geolocation (within ~1,750 feet) is sensitive data under TDPSA. We only collect it with your explicit prior consent. You may withdraw consent at any time through your browser's site permissions.

  • Right Against Discrimination

    We will not discriminate against you — deny services, charge higher prices, or provide lower quality — because you exercised your privacy rights.

To exercise Texas rights: email admin@mismile.dental with subject "Texas Privacy Request." Response within 45 days. Appeals denied by us may be referred to the Texas Attorney General.

California Resident Rights — CCPA/CPRA

  • Right to Know

    Know what categories and specific pieces of personal information we have collected about you, the sources, our business purposes for collection, and any third parties with whom we share it — covering the preceding 12 months.

  • Right to Delete

    Request deletion of personal information we have collected about you. We will also direct our service providers to delete your information. Certain exceptions apply (legal obligations, completing transactions, etc.).

  • Right to Correct

    Request correction of inaccurate personal information we maintain about you, taking into account the nature of the information and the purposes of processing.

  • Right to Opt Out of Sale or Sharing

    Opt out of the sale or sharing of your personal information, including for cross-context behavioral advertising. Submit opt-out request →

  • Right to Limit Use of Sensitive Personal Information

    Direct us to limit our use of sensitive personal information — including precise geolocation — to only what is necessary to provide the services you request. We already limit this use by default.

  • Right to Data Portability

    Receive your personal information in a portable, readily usable format where technically feasible, allowing you to transmit it to another entity.

  • Right Against Discrimination

    We will not deny goods or services, charge different prices, or provide a different quality of service because you exercised your CCPA rights.

To exercise California rights: email admin@mismile.dental with subject "California Privacy Request." You may use an authorized agent. Complaints may be filed with the California Privacy Protection Agency.

How to Submit a Privacy Request

You may use any of the following methods. We do not require you to create an account. We will verify your identity using reasonable means before fulfilling your request.

Response timelines: We will acknowledge your request within 10 business days and respond in full within 45 days. We may extend by an additional 45 days (Texas) or 90 days total (California) where reasonably necessary, with notice. We will not charge a fee for requests submitted once per 12-month period.
